We primarily collect personal information through our Websites to manage our business relationship and process employment applications. Your personal information may be shared, including outside of your region, to authorized third parties to accomplish these purposes. You may have the right to access the personal information that we hold about you, request its correction, and revoke your consent to its use.

1. What is this Privacy Policy and what does it cover?


This Privacy Policy applies to our websites at https://www.mhi.ca/ (“MHI.ca”), https://www.pscad.com/ (“PSCAD.com”), https://mycentre.pscad.com (“MyCentre”), and https://www.mht.mb.ca/ (“MHT.mb.ca”) (together “Websites”), and any interactions with us by any means. In addition, this Privacy Policy applies to our collection, use, and/or disclosure of the personal information of employment candidates.
 
For clarity, this Privacy Policy does not apply to the collection, use, or disclosure of the personal information of our employees or former employees gathered through the course of employment.
 
Under applicable laws, we act as a data controller for the personal information we process in connection with this Privacy Policy. Please note that while this Privacy Policy outlines our role as a data controller, there may be other circumstances where we act as a data processor, which may be covered by separate agreements.
 
If you click through to links to third parties’ websites or applications from our Websites, this Privacy Policy does not apply to such external services. It is always a good idea to read their privacy policies to understand what they do with your information.

 

2. What information do we collect and why?


We collect your information for different purposes, particularly to manage our business relationship with you. You hereby agree that the information you provide to us is correct; otherwise, it is possible that we will be unable to provide you with our products or services. Please see the table below for more details.
 
Depending on the jurisdiction you are in, we may use different legal bases to process your information. In Canada, we rely on your consent. If you are in the European Union or the United Kingdom, we rely on different legal bases to justify our processing of your information, such as consent, the performance of a contract and our legitimate interests. Each time consent is the legal basis, you can withdraw your consent at any time. Below is a summary of the personal information we collect and the purposes for which we may use it.

 

1. Contact Information

Examples of Contact Information: First name, last name, title, gender, company, educational facility, email address, postal address, phone number, fax number.

Purposes and Means of Collection: We collect this information when you fill in the contact form on MHI.ca, PSCAD.com, or when you otherwise provide it to us. We use this personal information to:

(1) provide you with information about MHI and our operations, including, but not limited to, newsletters, marketing information, software updates and upcoming events; and

(2) manage and administer our contract(s) with you for products and services. 

 

2. Identification Information

Examples of Identification Information: License number, order ID number, personal identification number, photo, username -We collect this information when you provide it to us or when you register on MyCentre through the registration form.

Purposes and Means of Collection: We use this personal information to:
Manage and administer our contract(s) with you for products and services and to make business travel arrangements if you are visiting our offices for training and other business purposes.

 

3. Financial Information

Examples of Financial Information: Contact name, postal address, email address, bank account number, credit card information, billing rates.

Purposes and Means of Collection: We use this personal information to make or collect payment for goods or services, process invoicing and maintain vendor records.

 

4. Technical Information

Examples of Technical Information: IP address, date, time and duration of your visits on our Websites, the pages viewed and links clicked on our Websites, your language preferences, browsing history, web pages that redirected you to our Websites, machine name or number, username, network domain name, MyCentre account password hash, Windows version, Windows platform, culture name, Culture (in ISO 3 format), host UUID, BIOS serial number, local time.

Purposes and Means of Collection: We collect this data using cookies and pixels on our Websites, including those provided by trusted third parties who collect it on our behalf, or when we provide our products to you. We use this personal information to:

(1) to compile aggregate data about traffic and interactions on our Websites in order to provide and improve our products, services, website content, and advertising;

(2) support existing MHI products and develop new features and products; and

(3) administer protection and security measures and ensure compliance with applicable End User License Agreements.

In addition, we collect personal information from employment candidates during the hiring process. Below is a summary of the personal information we collect and the purposes for which we may use it.

 

5. Candidate Information 

Examples of Candidate Information: Information generally contained in CVs, such as full name, e-mail address, telephone number, postal address, professional experience, skills, career objectives, references, and criminal record (for successful applicants prior to onboarding).
 
Please do not include sensitive personal information in your application, such as details related to religion, ethnicity, political association, date of birth (age) or marital status. MHI does not knowingly collect sensitive personal information from employment candidates.

Purpose of Collection: We collect this data when you apply for our job opportunities or when you otherwise provide it to us. We use this personal information to:

(1) process your employment application, including assessing your qualifications, checking your references, identity verification and criminal record, and communicating with you about your candidacy;
 
(2) Determining appropriate compensation; and
 
(3) Complying with applicable legal requirements

Please note that we may also collect and use your information for any other purpose permitted or required by law.

3. How do we share your information?

We share your information with third parties where necessary to fulfil the purposes identified above, including as outlined in the summary below:
 
1. Service Providers
 
Explanation: We may share your information with our authorized third-party services providers providing us services such as website hosting, data storage, customer relationship management, payment and payroll processing, shipping, communications and background check providers.
 
2. Professional Advisors
 
Explanation: We may share your information with our legal, financial, accounting or other consultants to the extent necessary to operate our business and comply with applicable laws.
 
3. Affiliate Organizations
 
Explanation: We may share your information with our affiliates and parent organization, Manitoba Hydro, for auditing and corporate governance purposes.
 
4. Authorized Representatives and Contractors
 
Explanation: We may share your information with authorized representatives of our products and services and our contractors in your region. If you are located in the European Union or the United Kingdom, we may share your information with our representatives in the European Union or the United Kingdom in connection with the exercise of your rights with respect to your personal information.
 
5. Clients and Sub-consultants
 
Explanation: We may share your information with the companies we work with for specific business opportunities where you have confirmed your availability to participate.
 
6. Law Enforcement and Other Authorities
 
Explanation: We may receive requests by authorities to access your information. We will validate that the request is lawful before responding. When possible, we will advise you. We will only share what is strictly required.

4. How do we transfer your information?

Your information may be held at our offices, and those of authorized third parties as described above. Some of these third parties may be based or share your information outside of your region. By submitting information to us, you consent to the communication of your information to, and the storage of that information, outside of your region. While such information is outside of your region, it is subject to the laws of the jurisdiction in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other jurisdictions pursuant to local laws. However, our practices regarding your information will continue to be governed by this Privacy Policy.
 
Where required by applicable law, we comply with legal requirements providing adequate protection for the transfer of information to third countries. For example, if you are in the European Union or the United Kingdom, we are required to ensure that appropriate safeguards are in place prior to transferring your information out of the European Union or the United Kingdom, respectively, and we do so through standard contractual clauses or through other safeguards when they are available.

5. How do we secure and keep your information?

We implement physical, administrative and technical safeguards designed to preserve the confidentiality, integrity and security of information under our control. However, information transmitted on the Internet and/or stored on systems attached to the Internet is not 100% secure, and no security can provide absolute protection. As a result, we do not ensure, warrant or guarantee the security or integrity of such information.
 
We retain your information only for as long as is necessary for us to fulfil the relevant purposes specified in this Policy and to comply with our legal obligations.
 
We take steps to ensure that only those who need access to your information to perform their duties have access to it.

6. What are your rights regarding your information?

Under certain circumstances and subject to applicable laws, supported by a written request and proof of identification, you may consult the personal information that we have collected, used or shared, and/or ask that it be corrected, and/or withdraw your consent to our disclosure or use of personal information collected.
 
As required or permitted by law, you may be entitled to additional rights, including: (i) the right to control the dissemination of your personal information; (ii) the right to receive computerized personal information collected from you in a structured, commonly used and technological format and to have this information transferred directly to another organization; (iii) the right to be informed of and submit observations regarding automated decision-making; and (iv) the right to request information about data processing.
 
In the European Union and the United Kingdom, you may also benefit from these additional rights: (i) the right to revoke your consent when our processing is based on consent; (ii) the right to object to the processing of your personal information; (iii) the right to restrict the processing of your personal information; (iv) the right to data portability, which means that your personal information is provided to you or a third party in normal format to allow you to re-use them, including with another provider; and (v) the right to have automated decisions be reviewed by a human in some cases, and some rights over profiling.
 
Finally, you also have a right to lodge a complaint with a competent data protection authority, in particular in the country/territory where you normally reside, where we are based or where an alleged infringement of data protection law has taken place, such as the Office of the Privacy Commissioner of Canada.

In addition, if applicable, you may review and correct your personal information at any time in your MyCentre account.

7. How can you unsubscribe from electronic marketing communications?

Subject to applicable laws, MHI may send you electronic marketing communications including about our operations, newsletters, and upcoming events.
 
If at any time you wish to stop receiving marketing communications from us, we include an unsubscribe mechanism in all of our marketing emails or you can contact us as outlined in the section below “How can you contact us?”.
 
In addition, if applicable, you may update your communication preferences at any time in your MyCentre account.
 
Please keep in mind that, if you choose not to receive marketing communications, you will continue to receive transactional or account communications related to products and services that you have requested from us.

8. How will you know if this Privacy Policy changes?

From time to time, we may update this Privacy Policy. Where required by applicable law, we will notify you of these changes by publishing the updated Privacy Policy on our website. Updates will be effective when we post the revised Privacy Policy. This Privacy Policy was last updated as of the effective date listed at the top.
